Abstract
Legal formalism, which places compliance with written rules and procedural certainty as the primary orientation of legal decision-making, does not always adequately address the complexity of justice in society. This study aims to analyze how legal politics can serve as an approach to move beyond legal formalism and promote the realization of substantive justice. This research employs a normative legal research method using conceptual, statutory, and legal policy approaches. Legal materials are analyzed qualitatively by examining the relationship between legal certainty, justice, utility, and the objectives of lawmaking and law enforcement. The findings indicate that legal politics plays an important role in determining the direction of lawmaking, implementation, and enforcement so that they are not merely oriented toward procedural certainty but also consider the values of justice and societal needs. An integrative approach is necessary to reconcile the normative dimensions of law with the social, political, and economic contexts and the evolving values of justice within society. Therefore, moving beyond legal formalism does not mean disregarding legal rules, but rather placing those rules within a broader framework of legal objectives so that legal decisions can produce substantive justice. Ultimately, legal politics serves as an instrument to ensure that law is not only formally valid but also oriented toward justice, social utility, and the protection of societal interests.
