Abstract
Mediation in divorce cases is an important stage in the judicial process before the examination of the main case continues. At the Pasuruan Religious Court Class 1A, mediation is conducted as an effort to provide the parties with an opportunity to resolve their dispute amicably. This study examines the implementation of mediation in divorce cases, including its procedures, the role of judge mediators, and the supporting and inhibiting factors affecting the mediation process. The implementation of mediation refers to Supreme Court Regulation Number 1 of 2016 concerning Mediation Procedures in Courts and Supreme Court Chief Decree Number 108/KMA/SK/VI/2016 concerning Mediation Governance in Courts. Based on the observation of mediation practices, the success of mediation is influenced by the good faith and openness of the parties, as well as the communication skills, neutrality, and professionalism of the mediator. Meanwhile, strong intentions to divorce, serious marital problems, lack of good faith, mediation costs, and limited time may hinder the process. Mediation data for January-December 2025 recorded 99 cases, with 14 cases achieving full settlement, 60 cases achieving partial settlement, and 25 cases failing. These findings indicate that mediation provides an opportunity to reduce conflict and facilitate mutually acceptable solutions before the case proceeds to further examination.
